Thank you for choosing Treegress, a product developed and operated by MobiDev Corporation. This document outlines the terms governing your use of our advanced web UI and E2E Test Automation platform ("Service"). By utilizing our platform, you affirm your agreement with these Terms of Service ("Terms"), which delineate the mutual rights and responsibilities of MobiDev Corporation (hereinafter referred to as "MobiDev", "Company", "Treegress", "we", "us", or "our") and its users regarding the use of Treegress.
1. Acceptance of Terms
Your access to and use of the Treegress platform signifies your explicit acceptance of these Terms. If you disagree with any part of these Terms, you are not authorized to use the Service. Continued use constitutes ongoing acceptance of updates to these Terms.
If you purchase managed services under a separate Master Services Agreement, Order Form, Statement of Work, or other written agreement, that agreement will control if it conflicts with these Terms.
2. Description of Service
Treegress provides AI-driven web UI and end-to-end test automation capabilities. Depending on the plan or service purchased, Treegress may provide tools and services to:
- Analyze and map website structures;
- Generate and execute web UI and end-to-end test scenarios;
- Detect UI, functional, and end-to-end issues;
- Provide test results, video recordings, traces, logs, and AI-generated conclusions;
- Organize test cases and testing cycles; and
- Configure, operate, review, or maintain testing systems as part of a managed service.
Available features, execution limits, supported environments, service capacity, and support levels depend on the subscription plan, Order Form, or Statement of Work purchased by the user.
3. User Accounts
To utilize specific features of the Service, you are required to register and create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- Ensuring that all actions performed under your account adhere to these Terms.
Upon registration, you will establish administrative login details, including a username and password. Promptly notify Treegress of any unauthorized access or suspected breaches.
4. User Content
You are exclusively responsible for any data provided to the Service, including website addresses and authentication credentials. By submitting this data, you represent that:
- You possess all necessary rights to provide the data.
- The data does not infringe upon third-party intellectual property or privacy rights.
Ownership of your data remains with you. Treegress claims no rights over your content except as required to provide the Service or improve its functionalities.
5. Acceptable Use
You agree to:
- Abstain from activities that are illegal, disrupt the Service, or compromise its functionality.
- Refrain from reverse engineering, decompiling, or otherwise attempting to derive the source code of the Service.
- Not create derivative works or use the Service for unauthorized purposes without prior written consent from Treegress.
Treegress reserves the right to monitor your usage and to suspend or terminate accounts for violations of these Terms.
6. Intellectual Property
Treegress retains exclusive ownership of all intellectual property associated with the Service, including software, designs, and proprietary features. These elements are protected by applicable copyright, trademark, and patent laws. Users must refrain from actions that infringe upon Treegress’s intellectual property rights.
7. Confidentiality
During your engagement with Treegress, you may access proprietary or confidential information.
Both parties agree to:
- Treat the other party’s confidential information with the highest degree of care.
- Utilize such information exclusively to fulfill obligations under these Terms.
This confidentiality clause remains binding even after the termination of your access to the Service.
8. Fees and Payments
Treegress is a paid Service. Current prices, subscription periods, usage limits, and included features are shown on the Treegress website, during checkout, or in the applicable Order Form or Statement of Work.
Fees already paid are non-refundable, except where expressly agreed by Treegress in writing.
Treegress may change its prices by providing reasonable advance notice. Any price change will apply from the next renewal period and will not retroactively change fees already paid for the current billing period.
Third-party licenses, infrastructure, or other external costs are not included unless expressly stated in the applicable plan, Order Form, or Statement of Work.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TREEGRESS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT. WHILE TREEGRESS ENDEAVORS TO MAINTAIN OPTIMAL PERFORMANCE, NO GUARANTEES ARE MADE REGARDING UNINTERRUPTED OR ERROR-FREE OPERATION.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREEGRESS’S TOTAL LIABILITY FOR ANY CLAIMS IS LIMITED TO THE FEES PAID BY THE USER IN THE 12 MONTHS PRECEDING THE CLAIM. UNDER NO CIRCUMSTANCES MAY A USER RECOVER DAMAGES OR OTHER MONETARY COMPENSATION FROM TREEGRESS IN AN AGGREGATE AMOUNT GREATER THAN THAT AMOUNT. TREEGRESS IS NOT RESPONSIBLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE SERVICE.
11. Term and Termination
These Terms remain effective as long as you use the Service.
Treegress reserves the right to:
- Terminate access without prior notice for any violation of these Terms.
- Modify or discontinue the Service at its discretion.

- Intellectual Property
- Confidentiality
- Limitation of Liability
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of the state of Georgia, USA, without regard to conflict-of-law principles.
13. Changes to these Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website or by sending you an email. Continued use of the Service following such changes constitutes acceptance of the updated Terms.
